Instant loan apps can put money in your account within minutes — but India has also seen many fake apps that charge hidden fees, misuse personal data and harass borrowers. To protect customers, the Reserve Bank of India (RBI) issued Digital Lending Guidelines in September 2022, later consolidated into the Digital Lending Directions, 2025. Here's what these rules mean for you.
Key RBI rules every genuine loan app must follow
| RBI rule | What it means for you |
|---|---|
| Lender must be RBI-regulated | The actual lender must be a bank or an RBI-registered NBFC, and the app must clearly show its name. |
| Money goes directly to/from your bank account | Loan disbursal and repayment must happen directly between your account and the lender's account — no third-party "pool" accounts. |
| Key Fact Statement (KFS) | Before you sign, you must get a KFS showing the Annual Percentage Rate (APR) — the all-in cost including interest and fees. No charge that isn't in the KFS can be collected. |
| Cooling-off period | You can exit the loan within the cooling-off (look-up) period by repaying the principal and proportionate APR, without any penalty. |
| No automatic credit limit increase | Your limit can't be increased without your explicit consent. |
| Your data, your consent | Apps can collect only need-based data with your consent, and cannot access your contacts, photos or files. |
| Fair recovery | Recovery agents' details must be shared with you; threats and harassment are not allowed. |
| Grievance officer | Every lender and app must have a grievance redressal officer listed on the app and website. |
How to check if a loan app is genuine
- Find the lender's name in the app and check it is a bank or an NBFC registered with RBI (RBI's website lists registered NBFCs).
- Check RBI's list of digital lending apps — RBI now publishes the apps declared by regulated lenders on its website.
- Read the Key Fact Statement — compare the APR, not just the "interest rate".
- Never pay an upfront fee to "release" a loan — genuine lenders deduct fees from the loan amount and show them in the KFS.
- Deny unnecessary permissions — an app asking for your contacts or gallery is a red flag.
Red flags of a fake loan app
- Not linked to any bank or registered NBFC
- Asks for advance "processing" or "GST" fees
- Very short tenure (7–15 days) with extremely high charges
- Threatens to message your contacts or post your photos
Where to complain
- First, write to the lender's grievance redressal officer.
- If not resolved within 30 days, complain to the RBI Ombudsman at cms.rbi.org.in.
- Report illegal lending apps on RBI's Sachet portal (sachet.rbi.org.in).
- For harassment or fraud, call the cyber crime helpline 1930 or visit cybercrime.gov.in.
